What a Florida Title Search Covers
Before you buy, we search the public records to confirm the seller can transfer clear ownership and to find anything that could follow the property to you.
Owner’s and Lender’s Title Insurance
A lender’s policy protects your mortgage lender up to the loan amount, and lenders require it. An owner’s policy protects you, the buyer, up to the purchase price for as long as you or your heirs own the property.
Both are paid once, at closing. There is no monthly premium. If a covered problem from before your purchase appears later, such as a forged deed or an unknown heir, the policy pays to defend your ownership or covers the loss.
Florida Title Insurance Rates Are Set by the State
Florida promulgates title insurance premiums, which means every title company and underwriter charges the same premium for the same policy. What differs between companies is service and their own fees, such as the closing fee.
| Amount of coverage | Rate per $1,000 |
|---|---|
| Up to $100,000 | $5.75 |
| $100,000 to $1 million | $5.00 |
| $1 million to $5 million | $2.50 |
| $5 million to $10 million | $2.25 |
| Over $10 million | $2.00 |
Example: an owner’s policy on a $400,000 home is $575 for the first $100,000 plus $1,500 for the next $300,000, for a premium of $2,075 before endorsements. A lower reissue rate can apply when the property was insured before; we check this for you.
Who Pays for Title Insurance in Florida
In most Florida counties, including Orange, Seminole and Osceola, the seller customarily pays for the buyer’s owner’s policy, and the buyer pays for the lender’s policy. In Miami-Dade and Broward counties the buyer traditionally pays for the owner’s policy. The purchase contract always decides.
